1. Overview of The North Pole Shoppe Customer Care Program
The North Pole Shoppe Customer Care Program (the "Program") is a loyalty program sponsored by Australian Pole Fitness Studios Pty Ltd ("APFS Group") through which customers ("Participants") can:
- Earn points ("Points") that will be credited to a Participant's store account.
- Have their order number entered into a monthly prize draw.
Participants may redeem Points for discounts on purchases through The North Pole Shoppe® store as outlined in the following Terms and Conditions. The Program is available to customers of both TearAid Australia® and Lupit Pole Australia.
2. Eligibility and Participation in the Program
2.1 Program Initiation & Opt-Out
Participation in the Program begins automatically once a customer selects and adds products to their cart, enters personal, contact, and billing details, and receives an Order Confirmation Number. To opt out of the Program, click here and and enter OPT OUT in the subject line.
2.2 Account Creation
Customers may create an account at The North Pole Shoppe® without placing an order. To create an account, Click Here.
2.3 Terms of Service & Program Precedence
The APFS Group's Terms of Service are an integral part of these Terms and Conditions. In the event of a conflict between the Terms and Conditions of this Program and APFS Group's Terms of Service, the Program's Terms and Conditions shall take precedence. 2.4 Minor Participation & Guardian Responsibility
If you are a parent or legal guardian of a minor (a person under 18), you assume all risks and liability associated with the minor's access to this website. You agree to be responsible for the minor's participation and to be bound by these Terms and Conditions.
2.5 Account Limitations & Business Accounts
Each individual may hold only one Program Account per email address, regardless of whether multiple people use the same email. The registered account hold is considered the official Participant. If an account is set up as a Business Account, any change in the designated Participant must be notified by email. To request a Participant change, send us an email.
2.6 Privacy & Data Handling
Personal information collected in connection with the Program is managed in accordance with APFS Group's Privacy Policy. To view the Privacy & Security Policy, Click Here. Participants agree that APFS Group may collect, use, disclose, transfer, and store personally identifiable data and information solely for the purpose of operating and managing the program.
2.7 Email Communication & Consent
By accepting these Terms and enrolling in the Program, Participants consent to receiving email communications at the email address associated with their North Pole Shoppe Account in accordance with the APFS Group's Privacy Policy.
3. Duration, Modification, and Termination of the Program
3.1 Program Continuation & Adjustments
The Program will remain active until APFS Group announces its termination, which may occur at any time, with or without notice to Participants. APFS Group reserves the right to suspend or modify the Program at its discretion, at any time, with or without notice. Any changes, including termination or suspension, may affect a Participant's ability to redeem accumulated Points.
3.2 Acceptance of Changes
By continuing to participate in the Program, Participants acknowledge and accept any modifications to these Terms and Conditions.
3.3 Amendments & Notifications
APFS Group may amend these Terms and Conditions and will notify Participants of changes by updating the official Terms and Conditions on its website. If any changes are considered significant, APFS Group may send a notification to the email address associated with The North Pole Shoppe Account before the updates take effect. Participants who disagree with the revisions may opt out of the Program. Continued participation after the updated Terms and Conditions take effect confirms a Participant's understanding and acceptance of the changes.
4. Earning Points
4.1 Qualifying Purchases & Point Rewards
APFS Group awards Points as a reward for purchases made at The North Pole Shoppe ("Qualifying Purchase").
4.2 Account Login Requirement
To earn Points, Participants must be logged into their North Pole Shoppe Account at the time of checkout.
4.3 Points Calculation & Payment Considerations
Points are awarded based on the final amount paid at checkout, whether paid in full or approved for financing. This amount is calculated after all discounts, including Points redemption, coupons, and promotional codes, have been applied. Shipping fees and other additional charges are excluded from the Points calculation.
4.4 Crediting Points & Return Period
Points will be credited to a Participant's account after the Qualifying Purchase has been delivered and the applicable return period has elapsed.
4.5 Login Requirement for Earning Points
If a Participant is not logged into the North Pole Shoppe Account during checkout, they will forfeit the ability to request Points for that purchase at a later time. However, APFS Group may, at its sole discretion, choose to credit Points to an account retroactively in such cases.
4.6 Returns & Point Deductions
If a Qualifying Purchase is returned after Points have been credited, APFS Group reserves the right to deduct the corresponding Points from the Participant's Reward Account.
4.7 Promotional Point Offers
From time to time, APFS Group may provide promotional Points to select or all Participants. These offers may be communicated via email, mail, or push notifications sent to the email address, shipping address, or phone number associated with the Participant's North Pole Shoppe Account.
5. Value of Points, Forfeiting Points, and Store Credits
5.1 Earning & Redemption Value
Points are earned at a rate of 1 Point per $1AUD spent. Each Point holds a redemption value of 1.25% of the purchase price (EX GST and SHIPPING).
5.2 Store Credit & Checkout Display
Store Credit generated from previously earned Points will be displayed at the shopping cart at checkout and may be applied as a discount on Qualifying Purchases.
5.3 Store Credit Limitations
Store Credit generated from Points does not constitute property, does not accrue interest, and cannot be redeemed for cash. Points are non-transferable and non-assignable for any reason. They cannot be transferred upon death, divided in legal matters, or otherwise reassigned by operation of law. Points may not be sold, transferred, or traded under any circumstances without explicit authorisation.
5.4 Account Security & Responsibility
Participants are responsible for maintaining the confidentiality of their North Pole Shoppe Account and their Customer Care Program details.
5.5 Expiration of Points & Store Credit
Points and any associated Store Credit will be cancelled on December 31st each year for accounts that have been inactive for a 12-month period.
6. Redeeming Points Earned
6.1 Eligibility for Redemption
Participants may redeem Points for discounts on products available through The North Pole Shoppe® website, provided they are logged into their North Pole Shoppe Account at the time of purchase.
6.2 Store Credit Display
Store Credit generated from Points will be visible at checkout, allowing Participants to review and apply the available discount.
6.3 Redemption Choice & Account Retention
Participants may choose whether or not to apply their available Store Credit when completing a purchase. Unused Points and Store Credit will remain in the Participant's North Pole Shoppe Account as long as the account remains active.
7. General Terms and Conditions
7.1 Program Misuse & Eligibility Suspension
APFS Group reserves the right to suspend or discontinue the eligibility of any individual or organisation that engages in misuse of the Program, violates these Terms, or fails to comply with applicable State or Federal laws, statutes, or ordinances.
7.2 Participant Responsibilites
Participants are responsible for maintaining accurate and up-to-date contact information associated with their North Pole Shoppe Account.
7.3 Legal Compliance
The Program is subject to all applicable laws and regulations. Participants must ensure compliance with all relevant legal requirements.
7.4 Severability
If any provision of these Terms is deemed invalid or unenforceable by a court of competent authority, that provision shall be severed, and the remainder of the Terms and Conditions will remain in full force and effect.
